In the 2008 decision of Van Horn v. Watson, the California Supreme Court re-visited the Good Samaritan legal principle that a person does not have a duty to come to aid of another, but one who does come to aid of another must exercise due care. The Court held that Section 1799.102 of the California Health and Safety Code, which provides an exception to the general Good Samaritan law, applies only for persons who render emergency "medical care."

As Advocates for folks dependent on needs-based public benefits, we all experience repeated violations of the basic Constitutional rights of due process. When due process rights are violated within the course of the Medicaid eligibility process, or during the administrative hearing phase, an award of attorney fees and costs against the agency may be appropriate and necessary.

The Supreme Court ruled 5-4 against Pakistani citizen Javaid Iqbal. Iqbal’s pleadings were insufficient to allow his suit against former Attorney General John Ashcroft and former FBI director Robert Mueller, Justice Anthony M. Kennedy wrote in his majority opinion.
